What are the main changes following the consultation process?
Our finalised policy reflects a considered response to the feedback received, and we are confident it will support our overall aim of improving the availability and quality of Welsh language services for everyone. The adjustments we have made include:
- Continuing the current practice of inviting organisations to respond to complaints directly to us before deciding whether to investigate
- No longer considering whether the complainant has referred the complaint to the organisation when deciding whether to investigate
- Adjusting the interpretation of vexatious and frivolous complaints
- Committing to provide more information about our complaints and investigations procedure on our website
- Clarifying where civil penalties will be paid
- Providing further clarity on our arrangements to ensure the accessibility of the process and our commitment to making reasonable adjustments (e.g. enabling verbal complaints where necessary).
What are the next steps?
We will now present the Enforcement Policy to Welsh Ministers for approval, in accordance with the requirements of the Welsh Language Measure. The policy will become operational once ministerial approval has been granted.
