Challenge and appeal

After an organisation has received a compliance notice, it may challenge and appeal the requirement to comply with a standard if it does not agree that the duty is reasonable and proportionate. 

Submitting a challenge  

The first step is to submit a challenge to the Commissioner.  

This can be done either before or after the ‘imposition day’ – the date the requirement for the standard in question comes into force. 

An organisation must use the relevant form: 

The Commissioner will consider the evidence and consult with the organisation before making a final determination.

Appealing to the Tribunal

If an organisation does not agree with the Commissioner, the Tribunal will make a final decision.
